Countries Where CBD Oils is Legal
Mentioning the word hemp or marijuana out loud its enough to make a room go quiet. Anything having to do with cannabis or a derivative of has been taboo for so many years. Some people still don’t understand the difference between hemp and marijuana, its all bad for you right?
So far from what studies tell us using cannabidiol is safe if used as directed.
In this article, I will explain what CBD oil is and some of the legalities involved.
Two types of CBD oil
Cannabidiol can come from two sources which are either from medical marijuana or from hemp plants.
Both are cannabis strains but each one is grown for a different purpose. Each one has a different classification under the law.
Is CBD oil legal?
The quick answer to this question is yes. CBD oil extracted from the hemp plant is perfectly legal to buy and consume in the U.S
The law may seem confusing, but that is because people confuse hemp with marijuana.
There is a big difference between the two, marijuana has THC and is technically illegal under federal law, however, it has been legalized and approved by state law in many states.
CBD oils do not contain THC, it is not psychoactive therefore the law in the United States says that all CBD oils that contain no more than 0.3% THC are legal to buy and consume as a whole in the U.S
In the U.S CBD oil is not listed as a controlled substance
The U.S government lists certain parts of the hemp plant that can be used to produce CBD oil.
Parts that can be used to produce CBD oil include:
- Mature stalks
- Cake made form the seeds
- Sterilized seeds
What this means to the end consumer is that CBD oil that is derived from the above sources are not banned and the extracted cannabinoids are exempt from DEA enforcement.
Hemp oil cannot be legally cultivated in the U.S
In the past, it was illegal to cultivate hemp in all 50 states in the U.S, however on February 7, 2014, President Obama signed into law a new farm bill known as the Agricultural act of 2014 titled “legitimacy of Industrial Hemp Research” 1 This allowed higher learning institutions to cultivate hemp for the purpose of research.
Since the farm bill was introduced over 30 states have passed laws surrounding the cultivation of hemp. 16 of those states have approved laws that allow commercial production of hemp, however, on a federal level commercial production of hemp is prohibited and still regulated under the 1970 controlled substances act.
You don’t need a prescription to buy CBD oil so you can legally purchase pretty much anywhere.
Any cannabidiol oil produced from commercial sources in the U.S can be consumed as long as the percentage of THC is lower than the specified 0.3%.
Cannabidiol supplements can be purchased legally in all 50 U.S states
In spite of the laws that regulate hemp oil cultivation derivatives of hemp are sold in all 50 states. These include body and skin care products, edible foods, supplements and of course CBD oils.
Cannabidiol in other countries?
Every country is different and has its own rules and regulations on CBD oil use.
Australia is one country that has some very strict rules and is only prescribed for medical use. even so, people seem to have to jump through a lot of hoops to obtain CBD oil. on October 1st, 2017 CBD Oil 2(Full spectrum CBD Oil extract) was classified as Schedule 4 under the Australian government.
Using and buying CBD oil in the United Kingdom is legal as long as the THC content is below 0.2% which is just slightly lower than in other countries. Cannabis is currently a controlled substance in the U.K under the Misuse of Drugs Act 1971. A follow up of the law in 2001 now classifies it as a Schedule 1 which is a category given to substances with no medicinal value.
In the U.K most cannabinoids are considered controlled substances CBD or cannabidiol is not.
Industrial hemp, for example, may be grown with a license in the U.K since it is a strain of cannabis that has almost no THC.
When it comes to purchasing Cannabidiol in the U.K the concentrated amount you will find in CBD oil is 0.03.
European countries are some of the biggest consumers of cannabis yet some have strict rules about Cannabidiol.
France just recently passed laws allowing the consumption of CBD oils as long it contains less than 0.02%.
There are over 40 countries that allow the sale of Cannabidiol as long as it contains less than 0.02% THC.
Switzerland allows the sale of cannabidiol products that contain no more than 1% THC anything above that is classified as an illegal substance. THC is sold in many smoke shops across Switzerland.
In Canada, cannabidiol became legal in 2018 for both medical and recreational use.
In Mexico Cannabidiol became legal in 2017 for medical use, it classified THC as therapeutic and is sold legally as long as the percentage of THC does not exceed more than 1%.

While cannabidiol is legal in the list of countries above it is important to consult local regulations for specific percentage amounts and presentations available for personal consumption.
CBD oil is obvioulsy becoming more popular and is time goes by we will most likely see more countries making it legal. The medical beenfits are becoming more apparent and it can be used as an alternative for many prescription drugs thar are often harmful. CBD oils is also gaining popularity and used for treating several ailments that affect pets.
